The Prosecution team in the Court Martial case against Col Dr Kizza Besigye and his colleague Obeid Kamulegeya have amended the charge sheet to add a third accused person.
The new suspect is RO 743 Capt Denis Olaa.
The General Court Martial chaired by Robert Freeman Mugabe heard that Capt Olaa is a member of the UPDF, attached to the Armoured Brigade.
New Charges
The prosecution further amended the charge sheet to add another offence of “Treachery”
Besigye and Kamulegeya face charges related to security and unlawful possession of firearms and ammunition involving two pistols.
Defence lawyers protest
Defence lawyers led by Counsel Martha Karua however, opposed the amendment on grounds that it is meant to circumvent a pending ruling on the army court’s jurisdiction.
The team believes the prosecution was trying to add a serving army officer to the case to legitimise the trial of civilians in the military court.
“We object to the amendment before ruling on the jurisdiction of this court” Karua argued.
Counsel Luyimbazi Nalukoola, another defence lawyer also told the court that the amendment was intended to "preempt the jurisdiction ruling,” urging the chairman to “not allow the prosecution to defeat justice.”
